Spin 4 Kids – Participant Terms, Risk Warning and Waiver

  1. Event entry and fundraising

Each team must make an upfront payment of $700 to secure their place in Spin 4 Kids. This amount includes:

  • a $200 non-refundable entry fee; and
  • a $500 tax-deductible donation, which counts towards the team’s fundraising total.

Teams are asked to actively fundraise additional amounts in the lead-up to the event. Additional funds may be raised through activities such as BBQs, raffles, trivia nights, online donations or other approved fundraising activities. Where agreed with Variety NSW/ACT, additional fundraising amounts may also be invoiced to the team.

Each team may include between 1 and 10 participants. Individuals may also participate in the event.

Entry fees are non-refundable and entries are non-transferable unless otherwise agreed by Variety NSW/ACT in writing. Fees will be processed via Funraisin.

Funds raised through Spin 4 Kids will be used to support children who are sick, experiencing disadvantage or living with disability.

  1. Event changes, postponement or cancellation

Variety NSW/ACT may change, postpone, relocate or cancel the event if required for safety, operational, weather-related or other reasons beyond its reasonable control.

This may include, but is not limited to, strong winds, heavy rain, lightning, extreme heat, venue issues, equipment issues, public health directions, accidents, emergencies or other circumstances that make the event unsafe or impractical to proceed.

If the event is postponed, relocated or cancelled, entry fees, donations and other costs incurred by participants, including travel, accommodation or other personal expenses, will not be refunded unless required by law.

  1. Risk warning

I acknowledge that participation in Spin 4 Kids involves physical activity and carries inherent risks. These risks may include, but are not limited to:

  • muscle strain, joint strain, fatigue, dizziness or dehydration;
  • slips, trips or falls while getting on or off the bike or moving around the event site;
  • injury caused by incorrect bike set-up, incorrect riding technique or overexertion;
  • aggravation of an existing injury, illness or medical condition;
  • contact with other participants, event staff, volunteers or equipment;
  • damage to or loss of personal property; and
  • serious injury or, in rare cases, death.

I understand that riding a stationary spin bike can involve strenuous cardiovascular activity. I am responsible for deciding whether I am physically fit and medically able to participate. I agree to stop participating immediately if I feel unwell, dizzy, faint, short of breath, in pain or otherwise unable to continue safely.

  1. Participant acknowledgement

By registering for or participating in the event, I acknowledge and agree that:

  1. I participate voluntarily and at my own risk.
  2. I will take reasonable care for my own safety and the safety of others.
  3. I will follow all reasonable directions given by Variety NSW/ACT, event staff, instructors, volunteers, venue staff and contractors.
  4. I will use the spin bike and any event equipment only as directed.
  5. I will ensure my bike is adjusted appropriately for my height and comfort before riding, and I will ask for assistance if needed.
  6. I will not participate while under the influence of alcohol or drugs.
  7. I will not participate if I have a medical condition, injury or illness that makes it unsafe for me to do so.
  8. I am responsible for obtaining medical advice before participating if I am unsure whether I can safely take part.
  9. I am responsible for any personal property I bring to the event.
  10. I am responsible for any medical, ambulance, hospital or other costs arising from my participation, except to the extent caused by Variety NSW/ACT’s liability at law.

  1. Release and limitation of liability

To the maximum extent permitted by law, I release Variety NSW/ACT and its directors, officers, employees, volunteers, contractors, sponsors, agents and event partners from any claim, loss, damage, cost, expense or liability arising from or connected with my participation in or attendance at the event, including personal injury, illness, death, property loss or property damage.

This release applies whether the claim arises in contract, tort, negligence, statute or otherwise, except to the extent that liability cannot be excluded by law.

Nothing in this waiver excludes, restricts or modifies any rights or guarantees that cannot be excluded, restricted or modified under applicable law, including the Australian Consumer Law.

  1. Medical treatment

If I am injured or become unwell at the event, I consent to Variety NSW/ACT, event staff, volunteers, contractors or medical personnel arranging medical treatment or emergency assistance for me if they consider it necessary.

I acknowledge that I am responsible for any costs associated with medical treatment, ambulance transport or hospital care, except to the extent caused by Variety NSW/ACT’s liability at law.

  1. Media consent

I consent to Variety NSW/ACT and its authorised representatives photographing, filming, recording or otherwise capturing my image, voice, name, statements and participation at the event.

I agree that these materials may be used by Variety NSW/ACT for event reporting, fundraising, promotional, marketing, media, social media and archival purposes without payment or compensation.

If I do not wish to be photographed or filmed, I will notify Variety NSW/ACT before the event. I understand that Variety NSW/ACT will take reasonable steps to accommodate this request but cannot guarantee that I will not appear incidentally in crowd or event footage.

  1. Privacy

Variety NSW/ACT collects, uses and discloses personal information for the purpose of conducting, administering, promoting and reporting on the event, including processing registrations, identifying participants, communicating event information, managing safety and providing participant services.

Variety NSW/ACT may also use my contact details to communicate with me about future events, fundraising campaigns and other Variety NSW/ACT activities, unless I opt out.

Personal information will be handled in accordance with Variety NSW/ACT’s Privacy Policy.

  1. Minors

Participants under 18 years of age must have consent from a parent or legal guardian to participate. The parent or guardian must agree to these terms on behalf of the participant.

  1. Acceptance

By registering for or participating in Spin 4 Kids, I confirm that I have read, understood and agree to these Participant Terms, Risk Warning and Waiver.
